1. Scope
The following Terms and Conditions apply to all orders placed through our online shop. Our online shop is aimed exclusively at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person, or a partnership with legal capacity, who, when entering into a legal transaction, acts in the exercise of their trade, business, or profession.
2. Contracting Party, Conclusion of Contract, Correction Options
The purchase contract is concluded with ALTURA INTERACTIVE SOLUTION – FZCO.
By listing products in the online shop, we make a binding offer to conclude a contract for these items. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting your order, you will receive a confirmation by email.
3. Contract Language, Storage of the Contract Text
The language(s) available for concluding the contract: German, English, French, Spanish, Italian
We store the contract text and send you the order details and our Terms and Conditions in text form. For security reasons, the contract text is no longer accessible via the internet.
4. Delivery Terms
All products offered in this shop are either sent by email, are download products, or are services.
We generally do not ship products by post.
Shipping is generally free of charge.
5. Payment
The following payment methods are generally available in our shop:
Credit Card
You provide your credit card details during the order process. Your card will be charged after the goods have been shipped.
PayPal
In order to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, verify yourself with your access data, and confirm the payment instruction. The payment transaction is carried out by PayPal after the goods have been shipped. Further information is provided during the order process.
Google Pay
In order to pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland (“Google”), you must be registered with Google, have the Google Pay function activated, verify yourself with your access data, and confirm the payment instruction. Apple Pay
In order to pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA (“Apple”), you must use the “Safari” browser, be registered with Apple, have the Apple Pay function activated, verify yourself with your access data, and confirm the payment instruction. The payment transaction is carried out immediately after the order is placed. Further information is provided during the order process.
6 Cancellation/Refund
Cancellation is possible at any time before processing has begun!
A refund is no longer possible once the service has been rendered!
Any fees incurred will only be refunded in the event of a withdrawal or an error on our part.
7 Retention of Title
The goods remain our property until paid for in full.
8 Warranty and Guarantees
Unless expressly agreed otherwise below, the statutory liability for defects applies.
For used goods, the following applies: if the defect occurs after one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year of delivery of the goods can be asserted within the statutory limitation period of two years from delivery of the goods.
The above limitations and shortened periods do not apply to claims arising from damages caused by us, our legal representatives, or vicarious agents
• in the event of injury to life, body, or health
• in the event of intentional or grossly negligent breach of duty, as well as fraudulent intent
• in the event of breach of material contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on whose observance the contracting partner may regularly rely (cardinal obligations)
• within the scope of a guarantee promise, if agreed, or
• insofar as the scope of application of the Product Liability Act is opened.

9. Liability
For claims arising from damages caused by us, our legal representatives, or vicarious agents, we are always liable without limitation
• in the event of injury to life, body, or health
• in the event of intentional or grossly negligent breach of duty
• in the event of a guarantee promise, if agreed, or
• insofar as the scope of application of the Product Liability Act is opened.
In the event of a breach of material contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on whose observance the contracting partner may regularly rely (cardinal obligations), caused by slight negligence on our part, our legal representatives, or vicarious agents, liability is limited in amount to the damage foreseeable at the time of conclusion of the contract that must typically be expected to occur.
Otherwise, claims for damages are excluded.
10. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are not obligated and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
